Welcome to Padel Pointer! These Terms of Use ("Terms") govern your use of the Padel Pointer iOS and watchOS application (the "App"), provided by Alex Dernie ("we," "us," or "our").
By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. Use of the App
- Eligibility: You must be at least 13 years old to use the App.
- License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.
- Prohibited Conduct: You agree not to:
- Reverse engineer, decompile, or disassemble the App.
- Use the App for any illegal or unauthorized purpose.
- Harass, abuse, or harm another person via the App.
2. Health and Fitness Disclaimer
The App provides features that track workouts and health metrics (e.g., heart rate, calories).
- Not Medical Advice: The App is for informational purposes only and is not intended to diagnose, treat, cure, or prevent any disease. Always consult a physician before starting a new fitness program, especially if you have pre-existing health conditions.
- Accuracy: While we strive for accuracy, the data provided by the App (e.g., calorie count) is an estimate and should not be relied upon for medical purposes.
3. Subscriptions and Purchases
The App offers a "Padel Pointer Pro" subscription that unlocks additional features.
- Billing: Payment will be charged to your Apple ID account at confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Cancellation: You can manage and cancel your subscriptions in your App Store Account Settings. We cannot cancel subscriptions on your behalf.
- Refunds: All purchases are processed by Apple. We do not issue refunds directly. Please contact Apple Support for refund requests.
- Price Changes: We reserve the right to change subscription prices. Any price changes will be communicated to you in advance by Apple.
4. User Content and Data
- Ownership: You retain ownership of the data you enter into the App (e.g., match scores).
- Backups: Your data is stored on your device and synced to your personal iCloud account. We are not responsible for data loss due to device failure, detailed formatting of devices, or iCloud sync issues. We recommend regularly backing up your device.
5. Intellectual Property
The App, including its design, text, graphics, and code, is the property of Alex Dernie and is protected by copyright, trademark, and other intellectual property laws. "Padel Pointer" is a trademark of Alex Dernie.
6. Limitation of Liability
To the fullest extent permitted by law:
- The App is provided "as is" and "as available" without warranties of any kind, either express or implied.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the App.
- Our total liability for any claim arising out of these Terms or the App shall not exceed the amount you paid us in the last twelve (12) months.
Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or for fraud or fraudulent misrepresentation.
7. Third-Party Services
The App may use third-party services (e.g., RevenueCat, PostHog). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the content or practices of third-party services.
8. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of England and Wales.
